Within commercial leases, the ability for a Landlord to review the rent is an important provision for both Landlord and Tenant and the wording of such a clause, must be carefully analysed to determine the applicable rent. 

At review, rents cannot be increased arbitrarily and most must conform to comparable transactional evidence.  It is essential when analysing evidence that the details of the subject lease is compared against the other comparables cited, as this can have a major influence on the rent. 

F.G. Burnett has dedicated specialists in office, industrial and retail/licenced sectors, with considerable experience in advising on rent reviews of specialist properties, for both Landlords and Tenants.  Our knowledge of prevailing case law and specialist market expertise ensures the best result for our client.

When advising our clients it is always the aim to settle any rent review dispute by negotiated settlement, but in some instances it is necessary to refer the matter to an Independent Expert or Arbiter for resolution.  Referral of this kind is always a matter of last resort, however, the F.G. Burnett team are very experienced in conducting the referral process and putting together our client’s case for determination.  To this end, three of the F.G. Burnett rent review team have successfully completed a Post Graduate Certificate in Arbitration from Robert Gordon University,   four are either Members or Fellows of the Chartered Institute of Arbitrators and five sit on the RICS in Scotland’s Chairman’s Panel of Independent Experts and Arbiters, allowing us to adjudicate in Rent Review Disputes.
